Faucette<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF)&nbsp;<a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/05\/06\/2026-08928\/transferring-machine-guns-between-qualified-licensees\" target=\"_blank\" rel=\"noreferrer noopener\">published a proposed rule<\/a>&nbsp;on May 6 that would amend&nbsp;<a href=\"https:\/\/www.ecfr.gov\/current\/title-27\/chapter-II\/subchapter-B\/part-479\/subpart-G\/subject-group-ECFR86ea43ef6e4e815\/section-479.105\" target=\"_blank\" rel=\"noreferrer noopener\">27 C.F.R. \u00a7 479.105<\/a>&nbsp;to streamline and clarify the regulatory framework governing the transfer, manufacture, and possession of post-May 19, 1986 (post-86) machine guns by qualified manufacturers, importers, and dealers operating under the National Firearms Act (NFA). Wiley has advised and advocated on behalf of clients regarding this proposed regulatory revision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ATF has invited interested parties to submit comments on this proposed rule. Submissions&nbsp;<a href=\"https:\/\/www.regulations.gov\/document\/ATF-2026-0006-0001\" target=\"_blank\" rel=\"noreferrer noopener\">are due on July 6, 2026<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><u>Background<\/u><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under&nbsp;<a href=\"https:\/\/uscode.house.gov\/view.xhtml?req=(title:18%20section:922%20edition:prelim)\" target=\"_blank\" rel=\"noreferrer noopener\">18 U.S.C. \u00a7 922(o)<\/a>, the transfer and possession of machine guns registered after 1986 is generally prohibited, subject to limited exceptions for transfers to or by, or possession by or under the authority of, the United States, a federal agency, a state, or a state agency or political subdivision.
